Terms of Service — Luma + Sol

Welcome to Luma + Sol ("the app," "we," "us," or "our"), a private app for two partners to build a shared sky together. These Terms of Service ("Terms") are a legal agreement between you and the app's individual maker(s). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Who can use Luma + Sol

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the app. If you are under 18, you should review these Terms with a parent or guardian. By using the app you confirm you meet these requirements and that the information you provide is accurate.

2. Your account

You are responsible for keeping your login credentials secure and for activity that happens under your account. The app is designed for two paired partners; by pairing you agree that your shared content will be visible to your partner. Please notify us at lumasolapp@gmail.com if you believe your account has been accessed without your permission.

3. Your content

You keep ownership of the content you create in the app — your notes, answers, moods, photos, and other contributions ("Your Content"). You grant us a limited licence to store, process, and transmit Your Content only as needed to operate the app (for example, to sync it to your partner's device and back it up). We do not claim ownership of Your Content and we do not use it for advertising.

You are responsible for Your Content and confirm you have the right to share it. Do not upload content that is illegal, infringes someone else's rights, or that you do not have permission to share.

4. Acceptable use

Please use the app as intended — as a private space for you and your partner. You agree not to:

  • use the app for any unlawful, harmful, harassing, or abusive purpose;
  • attempt to access another couple's data or any account that is not yours;
  • probe, tamper with, reverse engineer, or attempt to bypass the app's security, purchase validation, or usage limits;
  • use bots, scrapers, or automated means to access the app; or
  • disrupt or overload the app's infrastructure.

We may suspend or terminate access that violates these Terms or that harms other users or the app.

5. Purchases, Stardust, and Supernova

The app offers optional purchases:

  • Stardust is a consumable in-app currency you can buy or earn through play. It has no cash value, is non-transferable, and is non-refundable except as required by law or the app store's policies.
  • Supernova is an auto-renewing subscription that unlocks premium features for both partners. Unless cancelled, it renews automatically at the end of each period and your app store account is charged the then-current price.

All payments are processed by the Apple App Store (and, in the future, Google Play) under their terms. Manage or cancel subscriptions in your app store / device account settings — cancelling stops future renewals but does not refund the current period. Prices, contents, and availability of purchases may change. Refund requests are handled by the relevant app store according to its policies.

6. Service availability and changes

We work to keep the app running, but we provide it "as is" and cannot promise it will always be available, uninterrupted, or error-free. We may add, change, or remove features, and we may suspend or discontinue the app or parts of it. We are not liable for content or features that change or become unavailable.

7. Termination

You may stop using the app and delete your account at any time via Settings → Delete account. We may suspend or terminate your access if you violate these Terms or use the app in a way that risks harm to others or to the service. Upon termination, your right to use the app ends; sections that by their nature should survive (such as ownership, disclaimers, and limitations of liability) will continue to apply.

8. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law. Luma + Sol is a companion app for relationships and is not a substitute for professional advice, counseling, or therapy.

9. Limitation of liability

To the maximum extent permitted by law, the app's maker(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the app. To the extent any liability cannot be excluded, it is limited to the amount you paid us, if any, in the twelve months before the claim.

10. Indemnity

You agree to indemnify and hold harmless the app's maker(s) from claims and costs arising out of your misuse of the app or your violation of these Terms or of someone else's rights.

11. Changes to these Terms

We may update these Terms as the app evolves. When we make material changes we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of the United States and the U.S. state in which the publisher resides, without regard to conflict-of-laws rules. Any disputes will be handled by the state or federal courts located there, unless a mandatory consumer-protection law in your country of residence provides otherwise.
